Terms of Service

1. About Zestful

Zestful ("we", "us", "our") is a personal health records application. These Terms of Service ("Terms") govern your use of the Zestful mobile application and any related services (collectively, the "Service").

By tapping "Agree & Get Started" during onboarding, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

2. Who Can Use Zestful

You must be at least 18 years old to create an account. If you are using the Service to manage health records for a minor family member, you confirm that you are their parent or legal guardian and accept responsibility for their data within the app.

3. What Zestful Is — and Is Not

Zestful is a personal health record-keeping tool. It allows you to scan, store, and organise lab reports, prescriptions, medications, and daily vitals for yourself and family members you choose to add.

Zestful is not a licensed medical device, a diagnostic tool, or a substitute for professional medical advice, diagnosis, or treatment. AI-generated health insights and improvement plans in the app are for informational purposes only. They may contain errors and should never be the sole basis for a health or medication decision. Always consult a qualified healthcare professional.

4. Your Account

You register using your Indian mobile phone number, verified by OTP. You are responsible for:

• Keeping your number and device secure
• All activity that occurs under your account
• Notifying us promptly if you suspect unauthorised access

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Your Health Data

You own your health data. You grant us a limited, non-exclusive licence to store, process, and transmit it solely to provide the Service to you.

We do not:

• Sell your health data to third parties
• Use your health data for advertising
• Share your identifiable health data with anyone except as required by law or as you explicitly choose (for example, sharing a report with a linked family member)

Data you share with family members through the family-linking feature is visible to those members within the app.

6. Acceptable Use

You agree not to:

• Upload content you do not have the right to share
• Reverse-engineer, decompile, or tamper with the app
• Store data belonging to someone who has not consented
• Use automated means to scrape or extract data from the Service
• Misrepresent your identity or impersonate another person

7. Account Deletion

You may delete your account at any time from the Profile screen inside the app. On deletion, your personal data and all records you added are permanently erased from our servers within 30 days. Records added by other family members linked to your account are not affected.

8. Availability and Changes

We aim to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time and will provide reasonable notice for material changes.

We may update these Terms from time to time. Continued use of the Service after an update constitutes acceptance of the revised Terms. The effective date at the top of this page always reflects the most recent version.

9. Intellectual Property

All software, design, trademarks, and content in the app — excluding your personal health data — are owned by or licensed to us. You may not reproduce, distribute, or create derivative works without our prior written consent.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" without warranty of any kind
• We are not liable for any health outcome, medical decision, or loss resulting from use of or reliance on the app or its AI-generated content
• Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim

Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded under Indian law.

11. Governing Law and Disputes

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.
